Court of Appeal has Monday morning confirmed National Resistance Movement (NRM)’s Peter Sematimba as the rightfully elected Busiro South Member of Parliament.
High Court in Kampala in June 2016 had declared the Busiro South seat vacant after it found that Ssematimba who was declared MP in the February 2016 elections did not have valid education requirements to serve.
The minimum qualification for a Member of Parliament is the Advanced level certificate of education.
Sematimba holds a Diploma in Electrical and Computer Technology, said to have been obtained from the Pacific Coast Technical Institute based in the US, which Justice Lydia Mugambe of the High Court found lacking and based on that to make her ruling.
The decision by the High Court came as a result of a petition filed in April 2016 by Stephen Sekigozi of the Democratic Party, who was among the losers in the election.
Through his Lawyers from Muganwa, Nanteza and Company Advocates, Sematimba appealed against High Court’s ruling that nullified his 2016 victory.
Deputy Chief Justice Stephen Kavuma dismissed the ruling of the High Court on Monday, maintaining Sematimba as the duly elected mp.
